Applicant does not file any Section 8/9 declaration.  Registration then canceled about 6 months ago.  Applicant files anew and recieves an office action with respect to geographically descriptiveness.   Is there any way to hold the USPTO responsible for approving the mark previously and not approving it now, e.g. estoppel argument?  I have looked around and cannot find the answer.

I found this website today while searching for effective ways to respond to an office action regarding liklihood of confusion. I think everyone on here is very helpful and courteous.

Anyway, my question. Would distinguishing my trademark application with a registered mark by arguing my mark is a trademark and the registered mark is a servicemark sufficient? Alone, it may not be but our names are a tad bit dissimilar. Think chocolate milk and chocolatemilky.

Let me preface this with I apologize for asking what may be EXTREMELY obvious to others on this site.

I received my NOA for the application that I placed for a Registered Trademark. According to the letter I am to put in place the trademark. I applied to use it on Clothing, T-shirts, Hats, etc. and additionally adhesive notepads.

I am not to use the Registered Trademark logo correct? ( ? ) If that's not used then how is my trademark protected? It's my understan...

I have looked around the TMEP and cannot find the answer.  Some descriptive marks are allowed to be on the supp. register if that mark is capable of distinguishing itself, however, I have seen many office actions of a descriptive mark where the TM Examiner did not offer the supplemental register.  Is this just a case by case basis?  How can one find out if a mark is capable of distinguishing itself before trying to register?
