Tracking Publication of TM for Opposition

Posted by . updated on 11/11/2009
Do you know if you can track a TM app and have the USPTO email me or notify me somehow when the app is published ro opposition?  I really dont want to have to return to the site over and over again or have to read the Gazzete

Thanks,

Linda

Something I did, that is really helpful is use the website ChangeDetection.com. What the website does is that you enter the URL for the TARR status and your email and anytime there is a change on that site, an email will be sent to your email stating there is a change.

My trademark application for example: I didn't like to constantly go to the USPTO site to check on the status so I signed up for the service (changedetection) and anytime there is a change, I get an email. The other day, I got an email saying there was a change, I went to the website and discovered that my application was now listed as being assigned to an examiner. It definitely saves time.

The USPTO does not provide a watching service but other companies (Thomson & Thomson, CT Corsearch, etc.) do for a fee.  If you are working with an attorney, he/she probably uses a docketing program or service that will remind them of when to check the OP's mark for publication; they may or may not charge you for that watching service, but it does take their time.  If you are not interested in paying for someone's service or assistance, the only alternative is to keep returning to the USPTO application until you see that a publication date has been assigned and then calendar that date yourself as the start of the opposition period.

I hope this helps.

You could create an internet shortcut with the address: http://tarr.uspto.gov/tarr?regser=serial&entry=SERIALNO (substituting the app's serial number, of course), and then put it in your startup folder.  Checking won't take more than a minute a day.  Alternatively, a weekly or bi-weekly check should also suffice.

Can anyone comment on whether it is worth it or not to file in Japan, China, Korea etc, from the enforcement and cost perspective?  I have heard that it is very difficult to enforce registered marks in some of the countries over there.

What other service would you like to see in a trademark docketing and monitoring service aside from:

  • Docketing engine with 4 reminders for every action at the USPTO
  • Similar trademark application and registration review
  • Similar domain name review
  • Search engine textual advertising review
  • TTAB item docketing

Should we add Ebay review for consumer products? Should we add another search that ...

If I wanted to find out how many TM a person had worldwide, where can I find that information?  For free.

I see the US has the USPTO database and the Madrid protocol has a database.    But what about countries that do not belong?  Do they have their own?
